1. Who these terms cover
These Terms of Use govern your use of hathorent.com and everything offered through it. In these terms, “Hathor”, “we”, “us” and “our” mean Hathor Entertainment LLC, a California limited liability company. “You” means the person using the site.
By using the site you accept these terms. If you do not accept them, please do not use the site.
2. Who may use the site
You must be 18 or older to send us a brief, submit music or submit any other inquiry through this site. You are responsible for the accuracy of what you send us.
3. What this site is
This site describes our recorded music, music publishing and merchandising services, presents music available for licensing, and publishes general writing about how the business works. Nothing on it is legal, tax or financial advice, and reading it does not create a client, artist or licensee relationship.
4. Licensing happens under a signed license
Music on this site is not licensed by browsing it, by receiving a file from us, or by agreeing something over email. A use is licensed only when a written license is signed, and that license names the music, the use, the territory, the term and the fee.
Until a license is signed, no use is authorized, including use in a pitch, a rough cut, a test or an internal presentation.
5. What we own
The recordings, compositions, written material, images, layout and the Hathor Entertainment name and marks are our property or used by us with permission. Nothing on this site transfers any right in them to you.
6. Music you send us
If you submit music, you keep everything you own in it. You are telling us that you have the right to send it, that the writer and ownership information you give us is accurate, and that no one else has to approve our listening to it.
Sending us music does not create an obligation on either side. It does not oblige us to sign you, represent you, release the music or respond on any particular timeline, and it does not stop us from working with music that is similar. We may keep a copy of what you send for our records.
7. What you may not do
Do not record, copy, scrape or republish music or material from this site. Do not use anything from it in a project, a pitch or a post without a signed license. Do not upload anything unlawful or misleading or that infringes someone else’s rights, and do not attempt to break, probe or overload the site.
8. No guarantee of results
Nothing here promises a placement, a release, a deal, a royalty figure or any other outcome, and no one acting for us is authorized to promise one.
9. Third party services
The site relies on third party services for hosting, email and analytics, and it links to sites we do not run. We are not responsible for the content or practices of those services, and their own terms apply when you use them.
10. The site is provided as is
The site and everything on it is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the site will be uninterrupted, timely, secure or error free.
11. Limitation of liability
To the fullest extent the law allows, Hathor Entertainment LLC and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or lost opportunities, arising out of your use of the site. Our total liability for any claim relating to the site will not exceed one hundred dollars.
This section limits liability for the site. Liability under a license or a recording, publishing or merchandising agreement is addressed in that agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising from your use of the site, the material you send us, or your breach of these terms.
13. Ending your access
We may suspend or remove access for anyone who breaches these terms, and we may change or stop offering the site. Sections 4, 5, 6, 10, 11, 12 and 14 survive.
14. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you and we both consent to that jurisdiction.
15. Changes
We may update these terms. When we do, we will change the effective date at the top, and for material changes we will post a notice on the site before the change takes effect.
